Partner Terms & Conditions

These Partner Terms & Conditions define the role, responsibility, conduct, payout rules, compliance requirements and limitations applicable to DSA Partners, Connectors, Freelancers, Work From Home Associates and Referral Program participants associated with KKGIF Services Private Limited.

1 Introduction

These Partner Terms & Conditions apply to all persons, entities and associates who join, register, work with or provide leads/services to KKGIF Services Private Limited as a DSA Partner, Sub-DSA, Connector, Freelancer, Work From Home Associate, Referral Partner, Marketing Partner, Lead Partner or any other similar partner category.

By joining or continuing with our partner/referral program, the partner confirms that he/she has read, understood and agreed to these terms, responsibilities, compliance requirements and payout conditions.

Important: A partner is an independent business associate and is not an employee, officer, legal representative, authorized signatory, lender, agent of lender, or final decision maker of KKGIF Services Private Limited. The partner cannot make false commitments or guarantee any loan, service, approval, payout, income or final outcome.

2 Partner Categories Covered

This policy applies to the following partner categories:

DSA Partner / Sub-DSA Partner who promotes, refers or assists in sourcing loan/financial service customers as per company and lender policy.
Connector Partner who connects potential customers, borrowers, businesses or service seekers with the company.
Freelancer Independent person who works on lead generation, customer support, documentation, field coordination or other assigned tasks.
Work From Home Associate Associate who works remotely for lead calling, customer coordination, data support, service follow-up or other approved activities.
Referral Partner Person who refers customers through referral link/code or direct reference and may be eligible for referral payout as per rules.
Marketing / Service Partner Partner who assists in promotion, customer acquisition, documentation support or multi-service lead generation.

3 Nature of Relationship

The partner relationship with KKGIF Services Private Limited is purely on independent partner, referral, commission, freelancer or business associate basis. Nothing in these terms shall be treated as employment, agency, partnership firm, joint venture, franchise, permanent appointment or employer-employee relationship.

  • Partner will not be treated as a company employee.
  • Partner is not entitled to salary, PF, ESIC, gratuity, bonus, leave benefits or employee benefits unless separately appointed in writing as an employee.
  • Partner is responsible for his/her own expenses, taxes, mobile, internet, travel and operational costs unless specifically approved in writing.
  • Partner cannot represent himself/herself as a director, employee, officer or authorized signatory of the company.
  • Partner cannot bind the company legally or financially without written authorization.

4 Role and Responsibilities

The partner shall perform duties in a professional, ethical and lawful manner. Responsibilities may include:

  • Generating genuine leads for loan, financial services, multi services and other approved services.
  • Explaining basic service process to customers without making false promises.
  • Collecting customer details and documents only with customer consent.
  • Ensuring that customer information submitted to the company is correct, complete and updated.
  • Assisting customers in documentation, form filling, eligibility understanding and service coordination, where permitted.
  • Forwarding leads/applications through official company channels only.
  • Maintaining proper communication and follow-up with customers and company team.
  • Following company process, lender guidelines, documentation checklist and compliance instructions.
  • Maintaining customer confidentiality and data security at all times.

5 Prohibited Activities

Partners are strictly prohibited from the following activities:

  • Making guarantee of loan approval, service approval, sanction amount, interest rate, payout, income or final result.
  • Charging unauthorized fees, cash, commission, processing charges or service charges from customers in the company’s name.
  • Taking payment in personal bank account, UPI, wallet or cash without written company approval.
  • Submitting fake, forged, edited, misleading or incomplete documents.
  • Misusing customer documents, OTP, PAN, Aadhaar, bank statement, mobile number or personal information.
  • Sharing customer data with any third party without authorization.
  • Using company name, logo, ID card, letterhead, certificate or brand material without permission.
  • Posting false advertisements, misleading offers, fake approvals or unauthorized social media promotions.
  • Threatening, pressuring, misleading, abusing or harassing any customer, employee, lender or service provider.
  • Working in a way that damages company reputation or violates law, RBI guidelines, lender policy or company policy.

6 Customer Data and Confidentiality

Partner must keep all customer data, documents, bank details, identity details, income details, business details, lead information, payout details, lender information and company process confidential.

  • Customer documents must be collected only for genuine service purpose.
  • Customer consent must be taken before collecting or sharing documents with the company.
  • Customer data must not be stored, copied, sold, leaked, forwarded or misused.
  • Partner must immediately delete/return customer documents if asked by the company, subject to process requirements.
  • Any data leakage, misuse or unauthorized sharing may result in termination, payout hold and legal action.

7 Compliance with Laws and Guidelines

Partner must comply with all applicable laws, rules, regulations, RBI-related customer safety practices, KYC norms, data privacy requirements, anti-fraud practices, consumer protection principles and company policies.

  • Partner must not participate in money laundering, fraud, fake documentation or illegal sourcing.
  • Partner must not collect OTP, PIN, password, CVV or confidential banking credentials from customers.
  • Partner must not make illegal recovery, threat, pressure or coercive communication.
  • Partner must report suspicious documents, fraud attempts or fake customers to the company immediately.
  • Partner must cooperate in audit, verification, complaint handling or compliance review.

8 Payout, Commission and Referral Benefits

Partner may be eligible for payout, commission, referral benefit or service incentive only as per the payout structure communicated by KKGIF Services Private Limited from time to time.

  • Payout is not guaranteed merely by lead submission or application login.
  • Payout is generally payable only after successful approval, disbursement, service completion and confirmation from lender/company records, as applicable.
  • Payout may vary based on product, lender, service type, slab, case status, quality, location, partner category and company policy.
  • Payout may be held, reduced, reversed or cancelled if the case is rejected, cancelled, withdrawn, fraudulent, duplicate, disputed or clawed back by lender/service provider.
  • TDS, tax, adjustment, penalty, chargeback or outstanding deduction may be applied as per applicable law and company policy.
  • Partner must submit required KYC, PAN, bank details, GST details, invoice or payout documents if required.
  • No payout will be made for unauthorized, fake, duplicate, self-generated fraudulent or policy-violating leads.

9 Lead Ownership and Duplicate Leads

Lead ownership will be decided as per company records, CRM entry, referral code, lead date, customer consent, source verification and internal policy.

  • If the same customer lead is received from multiple partners, company decision regarding lead ownership shall be final.
  • Old leads, existing customers, rejected customers, duplicate entries or already active cases may not be eligible for payout.
  • Partner must not claim payout on customer data already available with the company or lender unless approved in writing.
  • Lead manipulation, fake mobile numbers, forced customer consent or repeated duplicate entries may result in suspension.

10 No Income Guarantee

KKGIF Services Private Limited does not guarantee fixed income, minimum earning, monthly salary, confirmed payout, fixed target benefit, business success, customer conversion or profitability to any partner.

Partner’s earning depends on his/her own effort, lead quality, market conditions, customer eligibility, lender policy, service provider policy, approval status, disbursement status, cancellation status and company payout rules.

11 Branding, Marketing and Public Communication

Partner may use only approved marketing content, service information and communication format provided or permitted by the company.

  • Partner cannot create fake company pages, fake websites, fake offers or misleading advertisements.
  • Partner cannot use company logo, name, stamp, certificate or letterhead for unauthorized purpose.
  • Partner cannot issue sanction letters, approval letters, job letters, payout letters or commitment letters on behalf of the company.
  • Partner cannot represent any bank/NBFC/lender unless specifically authorized by the concerned entity.
  • All social media, WhatsApp, calling and marketing communication must be ethical, lawful and truthful.

12 Work From Home and Freelancer Rules

Work From Home Associates and Freelancers must follow task instructions, data security rules, calling discipline, customer communication guidelines and reporting process provided by the company.

  • They must not misuse customer database, leads, scripts, company process or internal information.
  • They must not share login credentials, sheets, customer data or internal work with outsiders.
  • They must submit genuine work reports and must not create fake calls, fake leads or false updates.
  • Any target, incentive or payout will be subject to verified work and company approval.
  • Company may stop work allocation at any time if performance, conduct, compliance or data security is not satisfactory.

13 Customer Charges and Payment Rules

Partner must not collect any unauthorized amount from customers. Any service charge, processing charge, document charge or payment must be collected only through official company-approved method, if applicable.

  • Customer should be asked to pay only to official company account/payment link, where applicable.
  • Partner must not receive payment in personal account unless written approval is given by the company.
  • Partner must not promise refund, waiver or approval against payment.
  • Any unauthorized collection may lead to termination, payout forfeiture and legal action.

14 Termination, Suspension and Payout Hold

KKGIF Services Private Limited reserves the right to suspend, deactivate or terminate any partner registration or association at any time due to misconduct, fraud, poor performance, customer complaint, data misuse, policy violation, unauthorized collection, false commitment or business reason.

  • Pending payout may be held during verification, complaint review, fraud check or dispute resolution.
  • Payout may be forfeited if the partner is found involved in fraud, fake documentation, unauthorized collection or data misuse.
  • After termination, partner must stop using company name, logo, ID, documents, data and marketing material immediately.
  • Termination does not remove liability for past misconduct, customer complaint, fraud or legal violation.

15 Indemnity and Liability

Partner shall be personally responsible for his/her own acts, omissions, commitments, misrepresentations, fraud, negligence, unauthorized collection, customer dispute, data misuse or violation of law/policy.

Partner agrees to indemnify and protect KKGIF Services Private Limited from any claim, loss, penalty, legal action, customer dispute, lender complaint, data breach or liability arising due to partner’s actions or violation of these terms.

16 Changes in Terms

KKGIF Services Private Limited may modify, update or revise these Partner Terms & Conditions, payout rules, eligibility criteria, partner categories, compliance requirements or service process from time to time. Continued association with the company after such changes shall be treated as acceptance of the updated terms.

17 Jurisdiction and Dispute Resolution

Any dispute, claim or legal proceeding arising out of or related to partner registration, referral program, payout, commission, customer dispute, service activity, termination, data misuse or these Partner Terms shall be subject to the jurisdiction of competent courts/authorities at Bhopal, Madhya Pradesh only.

The company may attempt internal resolution first, but legal rights and remedies shall remain available as per applicable law.

1 परिचय

ये पार्टनर नियम एवं शर्तें उन सभी व्यक्तियों, संस्थाओं और सहयोगियों पर लागू होती हैं जो KKGIF Services Private Limited से DSA Partner, Sub-DSA, Connector, Freelancer, Work From Home Associate, Referral Partner, Marketing Partner, Lead Partner या किसी अन्य समान पार्टनर श्रेणी के रूप में जुड़ते हैं, पंजीकरण करते हैं, कार्य करते हैं या lead/service प्रदान करते हैं।

हमारे partner/referral program से जुड़ने या कार्य जारी रखने पर partner यह स्वीकार करता है कि उसने इन नियमों, जिम्मेदारियों, compliance requirements और payout conditions को पढ़ा, समझा और स्वीकार किया है।

महत्वपूर्ण: Partner एक स्वतंत्र business associate है। वह KKGIF Services Private Limited का employee, officer, legal representative, authorized signatory, lender, lender का agent या final decision maker नहीं है। Partner किसी भी loan, service, approval, payout, income या final outcome की झूठी commitment या guarantee नहीं दे सकता।

2 शामिल पार्टनर श्रेणियां

यह policy निम्न partner categories पर लागू होती है:

DSA Partner / Sub-DSA ऐसा partner जो company और lender policy के अनुसार loan/financial service customers को source, promote या refer करता है।
Connector ऐसा partner जो potential customers, borrowers, businesses या service seekers को company से connect करता है।
Freelancer स्वतंत्र व्यक्ति जो lead generation, customer support, documentation, field coordination या assigned tasks पर काम करता है।
Work From Home Associate ऐसा associate जो remote तरीके से lead calling, customer coordination, data support, service follow-up या approved activities करता है।
Referral Partner ऐसा व्यक्ति जो referral link/code या direct reference के माध्यम से customers refer करता है और rules के अनुसार referral payout के लिए eligible हो सकता है।
Marketing / Service Partner ऐसा partner जो promotion, customer acquisition, documentation support या multi-service lead generation में सहायता करता है।

3 संबंध की प्रकृति

KKGIF Services Private Limited के साथ partner का संबंध पूरी तरह independent partner, referral, commission, freelancer या business associate basis पर होगा। इन terms को employment, agency, partnership firm, joint venture, franchise, permanent appointment या employer-employee relationship नहीं माना जाएगा।

  • Partner को company employee नहीं माना जाएगा।
  • Partner salary, PF, ESIC, gratuity, bonus, leave benefits या employee benefits का अधिकारी नहीं होगा, जब तक उसे लिखित रूप से employee नियुक्त न किया जाए।
  • Partner अपने खर्च, tax, mobile, internet, travel और operational cost के लिए स्वयं जिम्मेदार होगा, जब तक company द्वारा लिखित approval न दिया जाए।
  • Partner स्वयं को company का director, employee, officer या authorized signatory नहीं बता सकता।
  • Partner company को legally या financially bind नहीं कर सकता, जब तक written authorization न हो।

4 भूमिका और जिम्मेदारियां

Partner को professional, ethical और lawful तरीके से कार्य करना होगा। उसकी जिम्मेदारियों में शामिल हो सकता है:

  • Loan, financial services, multi services और अन्य approved services के लिए genuine leads generate करना।
  • Customer को basic service process समझाना, लेकिन कोई झूठा वादा न करना।
  • Customer details और documents केवल customer consent के साथ collect करना।
  • Company को submit की गई customer information सही, complete और updated हो यह सुनिश्चित करना।
  • जहां अनुमति हो, documentation, form filling, eligibility understanding और service coordination में customer की सहायता करना।
  • Leads/applications केवल official company channels से forward करना।
  • Customers और company team के साथ proper communication और follow-up रखना।
  • Company process, lender guidelines, documentation checklist और compliance instructions का पालन करना।
  • Customer confidentiality और data security हमेशा बनाए रखना।

5 प्रतिबंधित गतिविधियां

Partners के लिए निम्न गतिविधियां सख्त रूप से प्रतिबंधित हैं:

  • Loan approval, service approval, sanction amount, interest rate, payout, income या final result की guarantee देना।
  • Company के नाम पर customer से unauthorized fees, cash, commission, processing charges या service charges लेना।
  • Written company approval के बिना personal bank account, UPI, wallet या cash में payment लेना।
  • Fake, forged, edited, misleading या incomplete documents submit करना।
  • Customer documents, OTP, PAN, Aadhaar, bank statement, mobile number या personal information का misuse करना।
  • Customer data किसी third party के साथ बिना authorization share करना।
  • Company name, logo, ID card, letterhead, certificate या brand material का बिना permission उपयोग करना।
  • False advertisements, misleading offers, fake approvals या unauthorized social media promotions करना।
  • Customer, employee, lender या service provider को threaten, pressure, mislead, abuse या harass करना।
  • Company reputation को नुकसान पहुंचाने वाला या law, RBI guidelines, lender policy या company policy का violation करने वाला कोई कार्य करना।

6 ग्राहक डेटा और गोपनीयता

Partner को customer data, documents, bank details, identity details, income details, business details, lead information, payout details, lender information और company process को confidential रखना होगा।

  • Customer documents केवल genuine service purpose के लिए collect किए जाएंगे।
  • Documents collect या company के साथ share करने से पहले customer consent लेना होगा।
  • Customer data को store, copy, sell, leak, forward या misuse नहीं किया जाएगा।
  • Company द्वारा कहे जाने पर partner को customer documents delete/return करने होंगे, subject to process requirements.
  • Data leakage, misuse या unauthorized sharing होने पर termination, payout hold और legal action हो सकता है।

7 कानून और दिशानिर्देशों का पालन

Partner को सभी applicable laws, rules, regulations, RBI-related customer safety practices, KYC norms, data privacy requirements, anti-fraud practices, consumer protection principles और company policies का पालन करना होगा।

  • Partner money laundering, fraud, fake documentation या illegal sourcing में शामिल नहीं होगा।
  • Partner customer से OTP, PIN, password, CVV या confidential banking credentials collect नहीं करेगा।
  • Partner illegal recovery, threat, pressure या coercive communication नहीं करेगा।
  • Partner suspicious documents, fraud attempts या fake customers की जानकारी तुरंत company को देगा।
  • Partner audit, verification, complaint handling या compliance review में सहयोग करेगा।

8 Payout, Commission और Referral Benefits

Partner payout, commission, referral benefit या service incentive के लिए केवल उस payout structure के अनुसार eligible हो सकता है जो KKGIF Services Private Limited द्वारा समय-समय पर communicate किया जाए।

  • सिर्फ lead submission या application login से payout की guarantee नहीं होती।
  • Payout सामान्यतः successful approval, disbursement, service completion और lender/company records से confirmation के बाद payable होगा, जहां लागू हो।
  • Payout product, lender, service type, slab, case status, quality, location, partner category और company policy के अनुसार बदल सकता है।
  • Case reject, cancel, withdraw, fraudulent, duplicate, disputed या lender/service provider द्वारा clawback होने पर payout hold, reduce, reverse या cancel किया जा सकता है।
  • TDS, tax, adjustment, penalty, chargeback या outstanding deduction applicable law और company policy के अनुसार apply हो सकता है।
  • Partner को required KYC, PAN, bank details, GST details, invoice या payout documents submit करने होंगे, यदि required हो।
  • Unauthorized, fake, duplicate, self-generated fraudulent या policy-violating leads पर payout नहीं दिया जाएगा।

9 Lead Ownership और Duplicate Leads

Lead ownership company records, CRM entry, referral code, lead date, customer consent, source verification और internal policy के अनुसार तय होगी।

  • यदि same customer lead multiple partners से receive होती है, तो lead ownership पर company का decision final होगा।
  • Old leads, existing customers, rejected customers, duplicate entries या already active cases payout के लिए eligible नहीं हो सकते।
  • Partner company या lender के पास पहले से available customer data पर payout claim नहीं कर सकता, जब तक written approval न हो।
  • Lead manipulation, fake mobile numbers, forced customer consent या repeated duplicate entries होने पर suspension हो सकता है।

10 Income Guarantee नहीं है

KKGIF Services Private Limited किसी भी partner को fixed income, minimum earning, monthly salary, confirmed payout, fixed target benefit, business success, customer conversion या profitability की guarantee नहीं देती।

Partner की earning उसके own effort, lead quality, market conditions, customer eligibility, lender policy, service provider policy, approval status, disbursement status, cancellation status और company payout rules पर निर्भर करती है।

11 Branding, Marketing और Public Communication

Partner केवल approved marketing content, service information और communication format का उपयोग कर सकता है, जो company द्वारा provided या permitted हो।

  • Partner fake company pages, fake websites, fake offers या misleading advertisements नहीं बनाएगा।
  • Partner company logo, name, stamp, certificate या letterhead का unauthorized purpose के लिए उपयोग नहीं करेगा।
  • Partner company की ओर से sanction letters, approval letters, job letters, payout letters या commitment letters issue नहीं करेगा।
  • Partner किसी bank/NBFC/lender का representative नहीं बनेगा, जब तक concerned entity द्वारा specifically authorize न किया गया हो।
  • सभी social media, WhatsApp, calling और marketing communication ethical, lawful और truthful होना चाहिए।

12 Work From Home और Freelancer Rules

Work From Home Associates और Freelancers को company द्वारा दिए गए task instructions, data security rules, calling discipline, customer communication guidelines और reporting process का पालन करना होगा।

  • वे customer database, leads, scripts, company process या internal information का misuse नहीं करेंगे।
  • वे login credentials, sheets, customer data या internal work outsiders के साथ share नहीं करेंगे।
  • वे genuine work reports submit करेंगे और fake calls, fake leads या false updates नहीं बनाएंगे।
  • Target, incentive या payout verified work और company approval के subject पर होगा।
  • Performance, conduct, compliance या data security satisfactory न होने पर company work allocation कभी भी रोक सकती है।

13 Customer Charges और Payment Rules

Partner customer से कोई unauthorized amount collect नहीं करेगा। कोई भी service charge, processing charge, document charge या payment केवल official company-approved method से ही collect किया जाएगा, जहां लागू हो।

  • Customer को केवल official company account/payment link पर payment करने के लिए कहा जाएगा, जहां लागू हो।
  • Partner written company approval के बिना personal account में payment receive नहीं करेगा।
  • Partner payment के बदले refund, waiver या approval का promise नहीं करेगा।
  • Unauthorized collection होने पर termination, payout forfeiture और legal action हो सकता है।

14 Termination, Suspension और Payout Hold

KKGIF Services Private Limited misconduct, fraud, poor performance, customer complaint, data misuse, policy violation, unauthorized collection, false commitment या business reason के आधार पर किसी भी partner registration या association को suspend, deactivate या terminate करने का अधिकार रखती है।

  • Verification, complaint review, fraud check या dispute resolution के दौरान pending payout hold किया जा सकता है।
  • Fraud, fake documentation, unauthorized collection या data misuse साबित होने पर payout forfeited किया जा सकता है।
  • Termination के बाद partner company name, logo, ID, documents, data और marketing material का उपयोग तुरंत बंद करेगा।
  • Termination से past misconduct, customer complaint, fraud या legal violation की liability समाप्त नहीं होगी।

15 Indemnity और Liability

Partner अपने acts, omissions, commitments, misrepresentations, fraud, negligence, unauthorized collection, customer dispute, data misuse या law/policy violation के लिए स्वयं जिम्मेदार होगा।

Partner यह स्वीकार करता है कि उसकी actions या terms violation के कारण उत्पन्न किसी claim, loss, penalty, legal action, customer dispute, lender complaint, data breach या liability से वह KKGIF Services Private Limited को सुरक्षित रखेगा और indemnify करेगा।

16 Terms में बदलाव

KKGIF Services Private Limited इन Partner Terms & Conditions, payout rules, eligibility criteria, partner categories, compliance requirements या service process को समय-समय पर modify, update या revise कर सकती है। Changes के बाद company के साथ association जारी रखना updated terms की acceptance माना जाएगा।

17 न्यायक्षेत्र और विवाद समाधान

Partner registration, referral program, payout, commission, customer dispute, service activity, termination, data misuse या इन Partner Terms से उत्पन्न किसी भी विवाद, दावे या कानूनी कार्यवाही की स्थिति में न्यायक्षेत्र केवल भोपाल, मध्य प्रदेश के सक्षम न्यायालयों/प्राधिकारियों का होगा।

Company पहले internal resolution का प्रयास कर सकती है, लेकिन applicable law के अनुसार legal rights और remedies उपलब्ध रहेंगे।
